1) Acceptance of Terms
By accessing or using our website, requesting a quote, purchasing products, booking services, or receiving on-site work (collectively, the “Services”), you agree to be bound by these Terms & Conditions.
2) Services; Estimates & Scope
Estimates. Any estimates provided are non-binding and intended to outline expected labor, materials, and applicable taxes or fees. Final pricing may change if site conditions differ, additional work is required to meet code, or parts or labor requirements change. Any material changes will be communicated for approval.
Access & Safety. You agree to provide safe and unobstructed access to all work areas, disclose known hazards, and secure pets, children, or personal property as necessary.
Permits & Code Compliance. Where required, you authorize Evercool LLC to obtain permits on your behalf, with associated fees billed to you. All work will be performed in accordance with applicable codes and manufacturer specifications based on the agreed scope.
Refrigerants & Environmental Handling. Refrigerants are handled and recovered in compliance with applicable environmental regulations. Environmental or disposal fees may apply.
3) Scheduling, Cancellations & Delays
Scheduling Windows. Appointment times are estimates and may be affected by traffic, weather, emergencies, or part availability.
Cancellations / Rescheduling. A minimum of 24 hours’ notice is required. Same-day cancellations or missed appointments may result in a service call fee.
Force Majeure. Evercool LLC is not responsible for delays or failure to perform due to circumstances beyond reasonable control.
4) Payment Terms
Payment Due. Unless otherwise agreed in writing, payment is due upon completion of services (residential) or according to agreed commercial payment terms.
Deposits. Certain projects or special-order parts may require a non-refundable deposit once materials are ordered.
Late Payments & Collections. Past-due balances may incur late fees and reasonable collection costs, including attorneys’ fees, as permitted by law.
Non-Payment. Evercool LLC reserves the right to suspend or refuse future services for accounts with outstanding balances.
5) Parts; Returns
Parts & Materials. Evercool LLC may use original equipment manufacturer (OEM) parts or equivalent-quality components.
Returns. Installed or special-order electrical and refrigeration components are generally non-returnable unless defective under applicable warranty.
6) Limited Warranty
Labor Warranty. Workmanship is warranted for ___ days from the date of completion, unless otherwise stated in writing.
Parts Warranty. Parts are subject to manufacturer warranties, which vary by brand.
Exclusions. This warranty does not cover misuse, improper maintenance, pre-existing conditions, acts of God, electrical or power issues, third-party repairs, or unauthorized modifications.
Exclusive Remedy. To the maximum extent permitted by law, Evercool LLC’s obligation is limited to repair or replacement of defective workmanship or covered parts during the warranty period. THIS IS YOUR SOLE AND EXCLUSIVE REMEDY.
7) Customer Responsibilities
You are responsible for providing accurate information, safeguarding personal property near work areas, maintaining equipment in accordance with manufacturer recommendations, and paying for service calls unrelated to prior repairs or outside our control.
8) Website & Digital Services
Content. Website content is provided “as is” and may be updated without notice.
Prohibited Use. You may not scrape content, reverse engineer systems, or attempt to bypass security features.
Intellectual Property. All trademarks, content, and materials are owned by Evercool LLC or its licensors.
9) SMS / Text Messaging Program
By providing your mobile number, you consent to receive service notifications, appointment updates, estimates, invoices, and occasional marketing messages.

10) Disclaimers; Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND WEBSITE ARE PROVIDED “AS IS,” EXCEPT AS EXPRESSLY STATED HEREIN. EVERCOOL LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF USE OR PROFITS. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
New Jersey Notice: Nothing in these Terms limits rights that cannot be waived under New Jersey law, including the Truth-in-Consumer Contract, Warranty and Notice Act (TCCWNA). Any unenforceable provision will apply to the maximum extent permitted by law.
11) Indemnification
You agree to indemnify and hold harmless Evercool LLC from claims arising out of misuse of the Services, violation of these Terms, or negligent or willful misconduct.
12) Governing Law; Venue
These Terms are governed by the laws of the State of New Jersey. Exclusive venue lies in the state or federal courts located in Essex County, New Jersey.
13) Changes to Terms
Evercool LLC may update these Terms from time to time. Changes are effective upon posting with an updated Effective Date. Continued use of the Services constitutes acceptance.
